Article 1. scope

These General Conditions apply without restriction or reservation to the downloading of the Application and the use of the Game, as well as to the various purchases of content offered within the Game.

The downloading of the Application and the use of the Game as well as the purchase of any content on the Game necessarily imply the Player's unreserved acceptance of all the provisions of the General Conditions. The Player will confirm this unreserved acceptance of all the provisions of the General Conditions when downloading the Application, as well as when purchasing any content from the Game, by checking the "I accept" box. The Player acknowledges that his acceptance was given after a prior and careful reading of the General Conditions. MYSTRAL has the right to modify all or part of the General Conditions at any time. In this case, MYSTRAL will inform you of the modification of the General Conditions. Article 2. The Game

Game registration

After downloading the Application from a legal download platform, and before any use of the Game, the Player may, when using the Application for the first time, access the Game:

- or by using their Facebook account (via Facebook connect). The email address and the list of Facebook friends will then be communicated to MYSTRAL, as part of the operation of the Game.
- or by not using their Facebook account, but by creating a pseudonym. In this case, no personal data will be communicated to MYSTRAL, except in the case of the purchase of one or more contents by the Player.
The Player is solely responsible for his login information and must ensure that no third party can access it. The Player is prohibited from communicating his login information to a third party. In particular, the Player guarantees MYSTRAL from any communication or use or statement made through his account.

When creating his account, the Player must in any case choose a pseudonym. This nickname will be visible to all other Players. Consequently, the Player must refrain from including in his pseudonym any data that is personal to him. The Player must therefore refrain from choosing his real name as a pseudonym, but must choose a fantasy name. The Player also refrains from including within this pseudonym any data infringing the rights of third parties, such as personal data of third parties and/or abusive and/or defamatory remarks.

Login to the Game

The Player with an account must log in before using the Application, either via Facebook Connect when registration for the Application was made via Facebook, or via the Platform, if content purchases have been made from the platform of his terminal.

The equipment (terminal / hardware / software) necessary for access to the Game as well as all other related costs, including telecommunications costs are the sole responsibility of the Player. The Player is solely responsible for the equipment used in connection with access to the Game.

Paid content

Downloading and access to the Application is offered by MYSTRAL free of charge. However, the Player may, for payment, access some of the content offered on the Application (the "Paid Virtual Goods"), such as:

- certain options allowing Players to be able to evolve within the game more quickly (Coin Boosts) or tokens (spins boosts).
Paid Virtual Goods are neither transferable nor refundable. No withdrawal period is applicable, due to the nature of the property.

Paid Virtual Goods are payable in a secure manner according to the payment terms provided and imposed by Apple's Apple Store, Google's Android Store. Apple, Google are solely responsible for the terms and the payment process in which MYSTRAL is not intended to intervene in accordance with the conditions imposed by the platforms. Any request for reimbursement or request relating to payment must be addressed to the services of Apple, Google or Amazon, depending on the terminal from which the purchase was made. Bank data is collected by Apple, Google or Amazon, beyond the control of MYSTRAL.

The Player will only be able to access his paid Virtual Goods by connecting to the platform (Apple's Apple Store, Google's Android Store) from which the paid Virtual Good(s) have been purchased. MYSTRAL cannot be held responsible and will not make any refund in the event of loss of virtual Good(s) paid for by the Player who could not or would not manage to connect to the platform from which the ( s) Paid Virtual Good(s) have been purchased.

Article 3. Communication with the member

3.3 Advertising and/or promotional messages

MYSTRAL may choose to broadcast advertising and/or promotional messages from advertisers and other partners from the Application. The Player expressly consents to receiving such messages.

Article 4. Rules of conduct

The Player undertakes and guarantees MYSTRAL that he will comply with all the provisions of these General Terms and Conditions as well as all applicable laws and regulations.

The Player undertakes in particular to:

- not to post threatening, hateful, abusive, defamatory, racist, obsene, indecent, pornographic content;
- not to post content infringing the rights of third parties (such as copyright or any other property right);
- not to post militant or political content;
- not to transmit or attempt to transmit viruses, Trojan horses or any pirate program for malicious purposes, spyware, etc.;
- not to post unsolicited or unauthorized advertising, as well as any content intended to promote a third-party product or service;
use the Application for fraudulent, illegal or malicious purposes.
Violation of this Article may result in the definitive termination of the Player's account, under the conditions of Article 7.

Article 5. Personal data

When the Player registers for the Game and connects via his Facebook account (Facebook Connect), he communicates to MYSTRAL his name and his personal email address associated with his Facebook account, as well as his list of Facebook friends. No other data is transmitted by Facebook.

When the Player registers on the Game but chooses not to connect via his Facebook account, the Player can use the Application and the Game without any personal data being communicated, by creating a pseudonym.

In the event of the purchase of content on the Application, the platform carrying out the transaction may communicate to MYSTRAL the name and personal email address of the Player associated with said platform.

Every Joeur undertakes to communicate to MYSTRAL only its own personal data, to the exclusion of any sensitive data and any information relating to third parties.

MYSTRAL undertakes to use the confidential information of Players only within the framework of the operation of the Game, as well as within the framework of the promotion of other games published by MYSTRAL.

Players' information may be communicated to MYSTRAL's technical service providers, solely within the framework of the operation of the Game.

In addition, MYSTRAL may implement technical means to obtain non-personal information relating to Players and intended to improve the functionality of the site, for example by tracking the number of visitors to certain pages.

MYSTRAL does not collect or process any bank details. The Apple Store, the Android Store do not communicate data relating to transactions made via their platform. These data are collected and processed by these platforms, without MYSTRAL being able to modify this method of payment.

Article 6. Intellectual property

MYSTRAL is and will remain the sole owner of the full and entire property of its brand. Any reproduction and/or use and/or partial or total affixing and/or modification and/or deletion of the trademark and the rights relating thereto, by any process whatsoever, in any form whatsoever, on any medium whatsoever and by any media whatsoever, is strictly prohibited without the express prior written authorization of MYSTRAL and is liable to legal proceedings.

Ownership of content

MYSTRAL holds all the copyrights and other property rights attached to the software and content available on the Game from the Application. The original works contained in the Game are and will remain the entire and exclusive property of MYSTRAL.

Any representation and/or reproduction and/or distribution and/or partial or total exploitation of the content reproduced in the Game such as software, animations, texts, videos, graphics and more broadly the general structure, by any process in any form whatsoever, on any medium whatsoever and by any media whatsoever, is strictly prohibited without the express prior written authorization of MYSTRAL and is liable to legal proceedings.

Authorization granted to the Player

Subject to full compliance with the General Conditions, MYSTRAL grants each Player a personal, non-commercial, limited, revocable, non-transferable license to access the Game and use it exclusively via the Application, for strictly personal and non-commercial purposes. .

Consequently, the Player as well as any third party is not authorized to:
- use the Game and/or one of its contents for commercial purposes without the express prior written authorization of MYSTRAL;
- to reproduce, copy, assign or exploit all or part of the content of the Game without first obtaining the express prior written authorization of MYSTRAL.
- The Customer is therefore required to respect the intellectual property rights of MYSTRAL and may not use, in any way whatsoever, the content appearing in the Game, or file a trademark and/or a drawing and model and/or a patent which would prejudice the rights of MYSTRAL.

Article 7. Suspension or termination

MYSTRAL may, at any time and without notice, terminate the account of a Player who does not comply with these General Conditions or other applicable conditions, or if MYSTRAL suspects, in its sole discretion, fraudulent, abusive or illegal activity associated with your account. MYSTRAL may also interrupt the operation of the Application at any time. The termination of a Player's account and/or the interruption of the operation of the Application may lead to the deletion of all Player data, such as for example the Players' paid Virtual Goods, without the possibility of reimbursement. .

MYSTRAL may also choose to temporarily suspend a Player's account, for a period that it freely defines, and/or to partially delete a Player's account, such as for example any of the content he may have posted .

The termination, deletion, or definitive or provisional suspension of a Player's account may be freely

The partial or total termination of a Player's account, as well as the deletion of content posted by the Player, is without prejudice to any legal proceedings that MYSTRAL could initiate against the Player.

MYSTRAL cannot be held liable for the suspension of a Player's account or the interruption of the operation of the Application.

Termination by the Player
The Player may at any time delete his account and/or the Application from his terminal. The deletion of the account and/or the Application may lead to the deletion of the Virtual Goods paid for by the Player and not used, without the possibility of reimbursement.

Article 8. Warranties

MYSTRAL does not provide any guarantee or assurance of any kind whatsoever on the Application and the Game. Each Player accepts and acknowledges that he uses the Application and the Game at his own risk and peril, and that MYSTRAL's liability does not cannot be sought because of its use.

Article 9. Clauses

If a clause or provision of the General Conditions were to be recognized in whole or in part as invalid or illegal, it would be deemed unwritten, without the validity of the other clauses or conditions being affected.
No waiver by MYSTRAL of a clause, provision or condition of these General Conditions shall be construed as (i) a definitive waiver of the application of the said clause, provision or condition of these General Conditions, or (ii) a waiver of the application of any other clause, provisions or conditions contained within these General Conditions.

The General Conditions have been written in French, and will be translated into different languages only in order to facilitate their understanding by non-French-speaking Players. In the event of a conflict between the French version and a translated version of the General Conditions, the French version will prevail.

Article 10. Disputes

These General Terms and Conditions are subject to French law with regard to substantive rules and formal rules. Any dispute must be subject to a prior attempt at amicable settlement.

In the absence of an amicable settlement, jurisdiction is assigned to the courts within the jurisdiction of the Paris Court of Appeal, notwithstanding multiple defendants or warranty claims.
